Dear Sir or Madam:

Enclosed please find a copy of Exhibit HR-2, submitted by the complainants in the matter of the human rights complaint filed against Ernst Zundel and his web-site (www.zundelsite.org) and heard by the Tribunal of the Canadian Human Rights Commission.

Exhibit HR-2 is provided to Google as part of an ongoing email exchange (a portion of which is attached for your reference) between Google and Canadian Jewish Congress Ontario Region. The exhibit provides a listing of 33 documents which were found by the Tribunal to be in contravention of section 13 of the Canadian Human Rights Act.

In previous correspondence with Google (November 17, 2004) we have provided a copy of the Reasons for Decision issued by the Tribunal of the Canadian Human Rights Commission in the matter of Ernst Zundel and the web-site knows as ?Zundelsite"(www.zundelsite.org). For your convenience we provide the text of the Order of the Tribunal:

We therefore order that the Respondent, Ernst Zandel, and any other individuals who act in the name of, or in concert with Ernst Zundel cease the discriminatory practice of communicating telephonically or causing to be communicated telephonically by means of the facilities of a telecommunications undertaking within the legislative authority of Parliament, matters of the type contained in Exhibit HR-2 and found on the Zundelsite, or any other messages of a substantially similar form or content that are likely to expose a person or persons to hatred or contempt by reason of the fact that that person or persons are identifiable on the basis of a prohibited ground of discrimination, contrary to s.13(1) of the Canadian Human Right Act.

For greater clarity, s.13(l) of the Canadian Human Rights Act reads as follows:

Hate messages - It is a discriminatory practice for a person or a group of persons acting in concert to communicate telephonically or to cause to be so communicated, repeatedly, in whole or in part by means of the facilities of a telecommunications undertaking within the legislative authority of Parliament, any matter that is likely to expose a person or persons to hatred or contempt by reason of the fact that that person or those persons are identifiable on the basis of a prohibited ground of discrimination.

As of this date, "zundelsite" has not complied with the order of the tribunal. Sixteen of the thirty-three articles listed in Exhibit HR-2 remain on the site (see attachment which provides URL information as of December 16, 2004).

Given Google's policy of adherence to the laws of the countries in which it operates, Canadian Jewish Congress Ontario Region requests the delisting of those "zundelsite" materials listed in Exhibit HR-2" from the service provided by Google Inc.
