It's original use was in a 2010 calendar "Hunks on the Right" produced by me (Diane Hubbard) and my organization Indianapolis Tea Party. The photo is of Treasurer Mourdock wearing blue jeans and blue jean jacket with red plaid shirt. He is holding an ax by a pile of wood that he chopped. The photo was taken by professional photographer Dale Hanke of Hanke Studios in Plainfield, Indiana. I personally paid for the photography session, designed the calendar, and fronted the money for the calendar production in Indianapolis, Indiana. We have trademark symbols on the calendar. Here is the link to the Indianapolis Tea Party website with the calendar & in the copy you can see where it mentions IN Treasurer Richard Mourdock as one of the persons featured in the calendar. http://indianapolisteaparty.com/2010-hunks-on-the-right-calendar Copyright holder?: I (or an authorized representative) created the image or have obtained rights to the image. Question: Why does a user-generated content site get DMCA takedown notices for links users have posted? Answer: Many copyright claimants are making complaints under the Digital Millennium Copyright Act, Section 512(d), a safe-harbor for providers of "information location tools." These safe harbors give providers immunity from liability for users' possible copyright infringement -- if they "expeditiously" remove material when they get complaints. Whether or not the provider would have been liable for infringement by users' materials it links to, the provider can avoid the possibility of a lawsuit for money damages by following the DMCA's takedown procedure when it gets a complaint. The person whose information was removed can file a counter-notification if he or she believes the complaint was erroneous. Question: What does a service provider have to do in order to qualify for safe harbor protection?
