Objet: Mise en demeure (art. L.336-2 CPI) Sites internet "Allostreaming.com", "AlloshowTV.com", "Alloshare.com" et "Allomovies.com" Madame, Monsieur, L'Association des Producteurs de Cinema (APC), la Federation Nationale des Distributeurs de Films (FNDF), Ie Syndicat de l'Edition Video Numerique (SEVN) ont recu les proces-verbaux d'agents assermentes de l'Association de Lutte contre la Piraterie Audiovisuelle (ALPA). lis ont pris note que copie sur support numerique amovible de ces proces-verbaux vous a ete notifiee par courrier recommande avec accuse de reception de l’ALPA en date du 12 aoOt 2011. En tant qu'organismes professionnels, nos syndicats ont qualite a se prevaloir notamment des dispositions de I"article L.331-1 alinea 2 du Code de la propriete intellectuelle aux fins de faire respecter les interets de chacune des professions qu'ils representent. C'est a ce titre qu'ils vous adressent conjointement la presente. Pour memoire, il est rappele que l'objet principal de l'APC, defini a l'article 4 de ses statuts, est plus precisement "Ia defense des interets profession nels des personnes physiques ou mora/es ... qui ont pour activite la production d'oeuvres cinematographiques et audiovisuelles", et a cet elfet " d'ester en justice pour defendre les interets collectifs de la profession". Celui de la FNDF est "de prendre en charge la defense des inten~ts moraux, economiques, industriels commerciaux et de l'lndustrie de la distribution de films" et, a cet effet, Vester en justice en leur nom et dans leur interet" (article 4 f) des statuts). Celui du SEVN, dElfini a l'article 4 de ses statuts, est plus preclsement "de defendre les interets professionnels de ses adherents" et, Ie cas echeant, "d'ester en justice en leur nom et dans leur interet". Les proces-verbaux precites des agents assermentes de l'ALPA caracterisent, a l'evidence, pour les syndicats soussignes, la nature manifestement illicite de l'activite des sites "Allostreaming.com", "AlioshowTV.com", "Alios hare. com" et "Allomovies.com" du fait de leur objet a l'aune des contrefayons massives constatees. Vous avez desormais parfaite connaissance de cette situation illicite a laquelle la presente vous invite a remedier, etant rappele que cette demarche ne releve pas d'une problematique de responsabilite a raison de l'information transmise ou stockee a l'initiative d'un tiers. Des lors, c'est votre concours actif qui est recherche en cooperation avec les representants des ayants-droits des secteurs profession nels victimes. Comme vous Ie savez, l'article L.336-2 du Code de Ie propriete intellectuelle autorise les organismes de defense professionnelle a solliciter en presence d'une atteinte a un droit d'auteur ou a un droit voisin occasion nee par Ie contenu d'un service de communication au public en ligne, toutes mesures propres a prevenir ou a faire cesser une telle atteinte a un droit d'auteur ou un droit voisin, a l'encontre de toute personne susceptible de contribuer a y remedier. C'est pourquoi il vous est demande de tirer toutes les consequences qui s'evincent des proces-verbaux dresses par les agents assermentes de l'ALPA qui ont ete communiques par cet organisme. En consequence, iI vous est demande de supprimer des reponses de votre moteur de recherche, les resultats (titre, descriptif, adresse URL) envoyant vers les pages web apparaissant en resultat a la suite des requates concernant les sites «Allostreaming.com », « alloshowtv.com », « alloshare.com )} et « allomovies.com ». Les syndicats soussignes ont par ailleurs entendu tenir compte des preoccupations exprimees maintes fois en d'autres occasions quant a la necessite de prevoir - dans la mesure du possible a l'aune de l't§tat de la technologie et des regles de l'art - un dispositif de nature a assurer aux mesures prises une certaine efficacite tout en evitant de generer des eftets indesirables injustifies. A cet eftet, les syndicats soussignes ont demande a l'ALPA de mettre au point, dans les limites ci-dessus rappelees, un outil de mise a jour afin de permettre la suppression, dans les meilleurs delais possibles, de toute mesure visant chacun des sites concernes consecutivement a des changements faisant que ces mesures pourraient generer des effets injustifies, Oll l'extension de telle(s) mesure(s) de dereterencement a tout site nouveau ne constituant que la copie de celui ou de ceux deja dereferences des lors que la stricte similarite des situations litigiellses aura ete etablie par Ie dispositif construit, outre un suivi des adresses IP et des noms de domaines s'agissant du ou des sites miroirs, sur une comparaison des elements structurels des sites internet avec ces derniers sites miroirs, cette similarite etant confirmee par un agent assermente de l'ALPA. Les mesures sollicitees sont comparables a celles deja prises s'agissant d'autres types de situations illicites. La mise en oeuvre de',; ces mesures peut s'inscrire dans un cadre judiciaire. Une demarche caracteristique d'un Internet responsable privilegierait la voie de la requete conjointe. A detaut d'une mise en oeuvre spontanee de ces mesures, ou de leur mise en oeuvre dans un cadre procedural gracieux, les syndicats soussignes se reservent l'initiative de toute(s) voie(s) judiciaire(s) necessaire(s) a la defense des interets des professions qu'ils representent. As professional organizations, our Trade Associations have the right to invoke the provisions of paragraph 2 of article L.331-1 of the (French) Intellectual Property Code for protection of the interests of each of the professions they represent. It is in that regard that they jointly send you this notice. SEVN's specific purpose, defined in article 4 of its by laws, is "the defense of the professional interests of its members"and, if necessary, "to take legal action on their behalf and in their interest': For the undersigned Trade Associations, the aforesaid Reports of ALPA's sworn agents clearly show that the Internet sites "Allostreaming", "Alloshare", "Allomovies" and "AlloshowTV" are operated in a manifestly illegal way, as is demonstrated by the extensive and purposeful Copyright infringements that were found therein. You are now fully advised of this illegal situation, which you are hereby requested to help rectifying, it being noted that the present process does not fall within the frame of issues related to a matter of liability for the information transmitted or stored at the initiative of a third party. Therefore, your active participation is sought through your cooperation with the representatives of the interested parties of the victimized business sectors. As you know, in the event of infringement of a Copyright or neighboring right occasioned by the content of an online communications services, article L.336-2 of the (French) Intellectual Property Code authorizes professional defense organizations to request any measures necessary to prevent or terminate any such copyright infringements, and to do so vis-a-vis any person who is in a position to contribute to the rectification of the situation. That is why we insist that you draw all of the consequences from the Reports of ALPA's sworn agents that you have received. Therefore, we ask you to remove from the responses of your search engine the data (title, description, URL address) linking to the web pages appearing at the end of the requests on the "Allostreaming", Alioshowtv","Allioshare", "Allomovies" sites. Also, the undersigned Trade Associations are taking into account the concerns that have repeatedly been expressed on other occasions regarding the necessity to implement - to the extent possible considering the state of the technology and the applicable rules -a system that ensures an effectiveness of the measures taken while avoiding the generation of effects that are unjustified and undesirable. To that end, the undersigned unions asked ALPA to develop, within the aforesaid limits, an updating tool that, with respect to the sites involved, removes as soon as possible any measure (s) if and after changes are made of such a nature that these measures might generate unjustified effects, and also extends such measure (s) to any new sites if they are only copies of site (s) already blocked, insofar as strict similarity of illegal situations has been established by the system and confirmed by a sworn agent of ALPA, plus a monitoring of IP addresses and domain names regarding mirror site (s), by comparing the structural elements of Internet sites with these mirror sites. The requested measures are similar to those that have already been taken with respect to other types of illegal situations. These measures may be implemented within the framework of a Court order. A "responsible Internet" would take steps that give priority to an amicable joint request presented to a Court. In the absence of voluntary implementation of these measures, or if they are not implemented in the context of an amicable procedure, the undersigned Trade Associations reserve their right to initiate any legal proceedings necessary to defend the interests of the professions they represent.
