Vivendiuniversalsucks.com confuses WIPO panel, WIPO Panel, November 20, 2001
Abstract: UDRP PANEL DIVIDED ON VIVENDIUNIVERSALSUCKS.COM CASE
A divided WIPO UDRP panel has ordered the transfer of
vivendiuniversalsucks.com to the company. The majority of
the panel found that adding the word sucks to a domain is
not always to be taken as "language clearly indicating that
the domain name is not affiliated with the trademark owner"
and thus ruled that the confusion prong was met. It
provides examples of a vacuum cleaner company promoting that
it sucks or a rock band naming its album "Suck on This" as
evidence that some might think that the sucks domain is
affiliated with the trademark holder.
